Terms of Use

These Terms govern your use of The Kitchen Wall Apple TV app and this pairing website. By downloading, accessing, or using The Kitchen Wall, you agree to them.

The service

The Kitchen Wall is a living-room display for Apple TV that can show calendars, photo albums, and news feeds you configure, plus optional weather. Configuration may be edited through this hosted setup site while Settings is open on the TV (QR code or short pairing code).

The Kitchen Wall is operated in connection with the pairing site at thekitchenwall.com. These Terms apply to the app and the pairing site together.

Our Privacy Policy explains how pairing sessions and on-device data are handled. It is part of your agreement with us.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use The Kitchen Wall on Apple TV devices you own or control, for household or personal use, subject to these Terms and the App Store rules.

You may not copy, modify, distribute, reverse engineer, or create derivative works of the app or pairing site except as allowed by law. The Kitchen Wall and related marks and design are our property (or used under license).

If you obtained the app from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies to the extent required by Apple. Where these Terms and Apple’s standard EULA both apply, Apple’s terms control for the licensed application relationship with Apple; these Terms control your relationship with us for the service and hosted setup.

Subscriptions, trials & billing

The Kitchen Wall may be offered as a free trial and/or a paid auto-renewable subscription through the Apple App Store (for example, a monthly subscription). Exact price, trial length, and product name are shown in the app and on the App Store product page at the time of purchase.

Refunds are handled by Apple under Apple’s policies, except where law requires otherwise.

Hosted setup

The pairing website exists so you can add calendars, albums, and feeds from a computer or phone. Sessions are short-lived. URLs and options you paste are held only for that session so the Apple TV can sync, then removed when the session ends or expires. They are not a permanent cloud backup of your configuration.

You are responsible for the links you paste (including “secret” calendar addresses and shared album links). Treat them like passwords. Do not paste credentials, private keys, or material you are not allowed to share.

Your content & third-party links

The Kitchen Wall displays content from sources you configure (ICS calendars, shared albums, RSS feeds, and similar). That content remains subject to the terms and policies of those providers. We do not claim ownership of your photos, events, or feed articles.

You represent that you have the right to use the links and content you configure for display in your household. We are not responsible for third-party content, availability, or accuracy (including news headlines, calendar data, or album photos).

You agree not to:

We may suspend access to hosted setup if we detect abuse or risk to the service.

Availability

We aim to keep the app and pairing site working, but we do not guarantee uninterrupted or error-free service. Features that depend on third parties (calendar hosts, photo shares, RSS publishers, weather data, Apple services) may fail when those services change or go down.

We may modify, suspend, or discontinue features with or without notice, including changing how pairing works.

Disclaimers

THE KITCHEN WALL AND THE PAIRING SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Kitchen Wall is not a substitute for official notifications, emergency alerts, medical devices, or critical scheduling systems.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (AND OUR SUPPLIERS) ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE KITCHEN WALL OR THE PAIRING SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE KITCHEN WALL SUBSCRIPTIONS IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (EXCLUDING APPLE’S COMMISSION WHERE THAT AFFECTS WHAT WE ACTUALLY RECEIVE). IF YOU HAVE NOT PAID US ANY SUCH AMOUNTS IN THAT PERIOD, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW (WHICH MAY BE ZERO WHERE ALLOWED).

Some jurisdictions do not allow certain limitations; in those cases, the limits apply to the fullest extent allowed.

Termination

You may stop using The Kitchen Wall at any time and cancel a subscription through Apple. We may suspend or end access to hosted setup or the service if you breach these Terms or if we discontinue the product. Provisions that should survive (including disclaimers, liability limits, and license restrictions) remain in effect.

Governing law

These Terms are governed by the laws of the State of New Jersey, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence say otherwise. Courts in New Jersey may hear disputes, subject to those mandatory rights.

If a provision is unenforceable, the rest still applies. These Terms are the agreement between you and us for The Kitchen Wall and the pairing site, and supersede prior conflicting terms for that subject. We may update these Terms by posting a new version here; the “Last updated” date will change. Continued use after an update means you accept the revised Terms.
